Acceptance of Terms

Welcome to Petal Pro. By downloading, accessing, or using our mobile application, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the app.

Description of Service

Petal Pro is an AI-powered photo editing application that allows you to enhance, modify, and edit your images using advanced artificial intelligence technology. The service includes both free and paid features, with usage credits that govern access to premium functionality.

Account and Eligibility

To use Petal Pro, you must:

• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• Create an account using a valid email address or through Apple Sign-In or Google OAuth
• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account

You are responsible for all activities that occur under your account.

Acceptable Use

When using Petal Pro, you agree to:

• Use the service only for lawful purposes
• Not upload or process images that violate any laws or third-party rights
• Not use the service to create content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Not attempt to reverse engineer, decompile, or disassemble the application
• Not use automated systems or software to extract data from the service
• Not interfere with or disrupt the service or servers
• Not impersonate any person or entity

User Content and Intellectual Property

You retain all rights to the images you upload to Petal Pro. By using our service, you grant us a limited, temporary license to process your images solely for the purpose of providing the editing services you request.

You represent and warrant that:

• You own or have the necessary rights to all images you upload
• Your use of the service does not infringe on any third-party rights
• You have obtained all necessary permissions for any identifiable persons in your images

The Petal Pro app, its design, functionality, and all related intellectual property remain the exclusive property of Petal Pro and are protected by copyright, trademark, and other intellectual property laws.

Subscriptions and Payments

Petal Pro offers in-app purchases and subscriptions that provide access to premium features and additional usage credits:

• Subscriptions are billed through your Apple ID account and managed through the App Store
• Auto-Renewal: All subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• You can manage or cancel your subscription in your App Store account settings
• Refunds are handled according to Apple's refund policies
• Prices are subject to change with notice; changes apply to subsequent billing periods
• Usage credits do not expire during an active subscription but are non-transferable

We reserve the right to modify pricing and features with reasonable notice.

Service Availability

We strive to provide reliable service, but we do not guarantee that:

• The service will be available at all times without interruption
• The service will be error-free or that defects will be corrected
• The results obtained from the service will be accurate or reliable

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time, with or without notice.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL MEET YOUR REQUIREMENTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PETAL PRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the service
• Any unauthorized access to or use of your data
• Any interruption or cessation of the service
• Any bugs, viruses, or other harmful code
• Any errors or omissions in any content

Indemnification

You agree to indemnify, defend, and hold harmless Petal Pro and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney fees, arising out of or in any way connected with your access to or use of the service, your violation of these Terms, or your violation of any rights of another party.

Termination and Account Deletion

We reserve the right to suspend or terminate your access to the service at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination, your right to use the service will immediately cease.

You can delete your account at any time within the Petal Pro app under Settings → Delete Account. Deletion permanently removes your data from our systems. Alternatively, you may contact us at support@petalprotechnologies.com to request account deletion. Termination or account deletion does not affect any subscription billing already processed.

Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by updating the "Last updated" date at the top of these Terms and, where appropriate, providing additional notice through the app or via email. Your continued use of the service after changes are posted constitutes your acceptance of the updated Terms.

Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
